Terms and Conditions
Welcome to Mont Luxe Collection. These Terms and Conditions ("Terms") govern your use of our direct booking website (the "Website"), your booking of any property managed by Mont Luxe Collection (the "Property"), and your stay at any such Property. By using the Website, completing a booking, or completing a check-in form, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Website or book a Property.
These Terms apply to all visitors and users of the Website, and to all occupants and visitors at the Property under your reservation.
1. Definitions
"Mont Luxe Collection," "we," "us," and "our" refer to MONT LUXE PROPERTY MANAGEMENT LLC, doing business as Mont Luxe Collection, and its affiliated entities, owners, employees, and agents. "Website" means our direct booking website and any associated services, content, or pages. "Property" means any short-term rental property managed or operated by Mont Luxe Collection. "Booking" or "Reservation" means a confirmed reservation to stay at a Property. "Responsible Guest" or "Guest" means the individual who books the Property and accepts these Terms; this person is at least 25 years of age and must be present for the duration of the stay. "Occupants" means all individuals staying overnight at the Property under the Reservation. "Visitors" means any non-overnight guests permitted at the Property. "House Rules," "Fee Schedule," and "Property Addendum" mean the supplementary documents that, together with these Terms, form the complete agreement between you and Mont Luxe Collection.
2. Use of the Website
You must be at least 18 years of age to use the Website and at least 25 years of age to make a Booking. You agree to provide accurate, current, and complete information when using the Website or completing a Booking. Misrepresentation may result in immediate cancellation without refund.
The Website is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. We make no representation regarding the accuracy or currency of any information on the Website beyond reasonable efforts to keep listings up to date.
The Website may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, privacy practices, or availability of those third-party sites.
3. Bookings, Payments & Charges
A Booking is confirmed only upon our acceptance and successful payment authorization. By completing a Booking, you authorize us to charge the payment method on file for the total reservation amount and any applicable post-stay charges, including but not limited to damage, missing items, excessive cleaning beyond a standard turnover clean (including additional labor, deep cleaning, stain or odor removal), overstay fees, or policy violations. Documentation will be provided for any post-stay charges.
All payments are non-refundable unless otherwise stated in your listing's cancellation policy or required by applicable Colorado law. Disputing a valid charge through your bank or payment provider constitutes a breach of these Terms.
4. Cancellation Policy
Cancellation terms are set by Mont Luxe Collection and vary by property and booking channel. The applicable policy is displayed at the time of Booking. No-shows and early departures are non-refundable unless otherwise stated in the applicable cancellation policy.
5. Eligibility & Responsible Guest
The Responsible Guest must be at least 25 years of age and must be present for the duration of the stay. If minors will be present, the Responsible Guest assumes full supervisory responsibility for their safety and behavior. The Responsible Guest is responsible for the conduct of all Occupants and Visitors and for any costs, damages, or penalties arising from the Reservation.
6. Property Use
The Property is for private residential use only. Maximum occupancy limits apply at all times — day and night. Quiet hours are from 10:00 PM to 8:00 AM daily. You must comply with all applicable House Rules, local ordinances, and HOA regulations.
The following are strictly prohibited without our prior written approval: events or parties beyond the approved guest count, commercial photography or video production, subletting or re-listing the Property, and any use that violates local laws or HOA rules.
Our properties are located in Colorado's mountain communities. Sounds and activity from the surrounding environment — including construction, wildlife, weather, and snow removal — do not constitute grounds for refunds.
7. Pets
Pets are permitted only at properties explicitly designated as pet-friendly and with our prior written confirmation. Any pet found to be in a property without prior written confirmation is deemed unauthorized. Unauthorized pets will result in additional fees and may result in early termination of your stay. Service animals recognized under the ADA are welcome at all properties with advance notice.
8. Safety & Amenities
Smoking, vaping, and the use of tobacco or cannabis are strictly prohibited anywhere on the grounds of every property, both inside and outside. This applies to both renters and guests. Violations will result in remediation fees and may result in early termination of your stay.
Guests must comply with all active fire bans, burn ordinances, and local regulations at all times. Fireworks and open burning are prohibited unless expressly permitted under current local restrictions and the House Rules. Fire pits may be used only when permitted by applicable fire restrictions and must be operated in accordance with all provided safety guidelines.
Use of hot tubs and all recreational amenities is at your own risk. Glass, soaps, bath bombs, dyes, or any foreign substances are strictly prohibited in hot tubs. Children must be supervised at all times. Any misuse resulting in damage, additional cleaning, or service disruption will be charged to the guest. Guests are responsible for proper use of the hot tub cover and spa cover lifter, per the posted instructions.
Use of elevators is at your own risk. Children are not allowed in elevators unsupervised. Any misuse resulting in damage or repairs will be charged to the guest. Guests are responsible for proper use of elevators, per the posted instructions.
9. Care of the Property
Please treat the Property as you would your own home. Any pre-existing damage must be reported to us within 4 hours of check-in. Failure to report may result in you being held responsible upon checkout. We are not liable for personal items left at the Property. Return shipping for lost items is at your expense.
10. Damage & Missing Items
Damage, missing items, and violations of the pet and smoking policies will be documented with photos and invoices. You will be notified of findings and agree to pay assessed amounts within 3 days of notification. Unpaid amounts will be charged to your payment method on file and, if necessary, pursued through legal channels.
11. Access, Check-Out & Overstays
Check-in time: 4:00 PM. Check-out time: 10:00 AM.
We reserve the right to access the Property with 24 hours' notice for inspections or maintenance, or immediately in the case of an emergency. Guests remaining beyond checkout without approval will be charged an overstay fee and may be subject to removal.
12. Force Majeure
We are not liable for service disruptions caused by circumstances beyond our control, including severe weather, natural disasters, utility outages, or government-mandated evacuations. Brief disruptions typical of mountain environments do not qualify for refunds.
13. Assumption of Risk & Indemnification
Your use of the Property and its amenities is at your own risk. To the fullest extent permitted by Colorado law, you agree to indemnify and hold harmless Mont Luxe Collection, its owners, employees, and agents from any claims, damages, or expenses arising from your stay — except where caused by our gross negligence or willful misconduct.
14. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms, the Website, your Booking, or your stay shall not exceed the total amount paid for your specific Reservation. We are not liable for any indirect, incidental, consequential, special, or punitive damages — including loss of profits, loss of data, business interruption, or loss of enjoyment — under any circumstances, even if we have been advised of the possibility of such damages.
15. Disclaimer of Warranties
The Website and all Properties are provided on an "AS IS" and "AS AVAILABLE" basis with all faults. To the maximum extent permitted under applicable law, Mont Luxe Collection expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no representation that the Website or any Property will meet your requirements, achieve any intended results, be compatible with any other software or systems, or operate without interruption.
16. Nature of Your Stay
Your Reservation creates a transient occupancy arrangement only. It does not establish a tenancy, lease, or any long-term residential right under Colorado law. We reserve the right to immediately remove any Guest who violates these Terms.
17. Termination
We reserve the right to suspend or terminate your access to the Website, cancel any Booking, or remove any Guest from a Property — without prior notice and without refund — for any breach of these Terms, the House Rules, or applicable law. Termination does not relieve you of any payment obligations or liability for damages incurred prior to termination.
18. Dispute Resolution
These Terms are governed by the laws of the State of Colorado, excluding its conflicts of law rules. If you have any concern or dispute, you agree to first attempt informal resolution by contacting us. Any unresolved disputes shall be resolved in the state or federal courts located in Grand County, Colorado. In any legal dispute, the prevailing party is entitled to recover reasonable attorney's fees and costs. Both parties waive the right to a jury trial.
19. Fees

Any post-stay charges will be documented with photos, invoices, or other supporting records and communicated to you in accordance with Section 10 (Damage & Missing Items). By agreeing to these Terms, you acknowledge and accept that such fees may apply and authorize Mont Luxe Collection to charge the payment method on file in accordance with Section 3 (Bookings, Payments & Charges).
20. Privacy
Your use of the Website and Booking of a Property is also subject to our [Privacy & Cookie Policy](/privacy-policy), which describes how we collect, use, and protect your personal information.
21. Communications Consent
By completing a Booking or providing your contact information, you consent to receive transactional and stay-related communications from Mont Luxe Collection by email, SMS, or phone, including booking confirmations, check-in instructions, payment notices, and operational updates. Standard message and data rates may apply. You may opt out of non-essential marketing communications at any time.
22. Severability & Waiver
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. No waiver of any breach will constitute a waiver of any subsequent breach.
23. Entire Agreement
These Terms, together with the applicable House Rules, Property Addendum, and Privacy & Cookie Policy, constitute the complete agreement between you and Mont Luxe Collection regarding your use of the Website and your stay at any Property.
Acknowledgment
I confirm that I am the Responsible Guest, that I am at least 25 years of age, and that I have read, understood, and agreed to these Terms and Conditions in full. I accept personal responsibility for all Occupants and Visitors under my reservation, including any applicable fees and charges as described in Section 19.
